Term: The terms of the various
coverages of this Warranty begin on the date on
which your home is deeded to you. In the event
occupancy occurs before completion of construction,
this warranty begins on the date of occupancy.
If it is necessary to postpone improvements, with
respect to the postponed items, it shall commence
upon completion of the items. The appropriate
time is referred to in this Limited Warranty as
the “Closing”.
Coverage: We warrant that:
For a period of one year after closing, the
floors, ceilings, walls, and other internal structural
components of the home which are not covered by
the other portions of this Limited Warranty will
be free of defects in material or workmanship.
For a period of one year after Closing, the
plumbing, heating, and electric wiring systems
and the septic tank (if we installed it) will
be free of defects in materials or workmanship.
For a period of one year after Closing, the roof
will be free of leaks caused by defects in material
or workmanship.
For a period of one year after Closing, the
following items will be free of defects in materials
or workmanship: doors (including hardware); windows;
electric switches, receptacles, and fixtures;
caulking around exterior openings; plumbing fixtures;
and cabinet work.
Manufactures’ Warranties:
we hereby assign and pass through to you the manufactures’
warranties on all appliances and equipment and
tangible personal property which we now possess
or shall possess at a future date. The following
are examples of such items of tangible personal
property, though not every home includes all of
these items and some homes may include tangible
personal property not in this list: range, dishwasher,
garbage disposal, ventilating fan, air conditioner.
Exclusions from coverage: We
do not assume responsibility for any of the following,
all of which are excluded from the coverage of
this Limited Warranty:
01. Lifestyle Homes Co gives no express warranties
nor any implied warranties with regard to tangible
personal property including, but not limited
to, an implied warranty of merchantability and
implied warranty of fitness for a particular
purpose.
02. Defects in appliances and pieces of equipment
and tangible personal property which are covered
by manufactures’ warranties. (We have
assigned these manufactures’ warranties
to you, and you should follow the procedures
in these warranties if defects appear in these
items.)
03. Damage due to ordinary wear and tear,
abusive use, or lack of proper maintenance of
your home.
04. Defects in items installed by you or anyone
else except us.
05. Damage as a result of work done by you
or anyone else except us.
06. Work done by you or anyone else except
us.
07. Loss or injury due to the elements.
08. Conditions resulting from condensation
on, or expansion or contraction of, materials.
09. Consequential or incidental damages.
10. Matching paint.
11. Damages to hard surfaces not noted on
the Walk Through List, including countertops,
vinyl floor, wood floors and ceramic tile.
No other Warranties: This Limited
Warranty is the only express warranty we give.
Implied Warranties, including, but not limited
to, Warranties of Merchantability, Fitness for
a Particular Purpose are excluded. This Limited
Warranty gives you specific legal rights, and
you may also have other legal rights which vary
from state to state.
Claims Procedure: If a defect
appears which you think is covered by this Limited
Warranty, you must write a signed letter describing
the defect to our office at the address appearing
on the bottom of this Limited Warranty. You must
tell us in your letter what time during a regular
business day you will be at home, so that we can
schedule service calls appropriately. If a delay
will cause extra damage (i.e., if a pipe has burst)
telephone us at (402)894-0780.
Repairs: Upon receipt of your
written report of a defect, if the defective item
is covered by this Limited Warranty, we will repair
or replace it at no charge to you, within 60-days
(longer if weather conditions, labor problems
or material shortages cause delays or if such
repairs cannot reasonably be completed within
the 60 days). Caulking treatment to shrinking
woodwork will be performed only once at the time
of your 11 month warranty appointment. The work
will be done by us or subcontractors chosen by
us. The choice between repair or replacement is
ours.
Not Transferable: This Limited
Warranty is extended to you only if you are the
first
purchaser of the home. When the first purchaser
sells the home or moves out of it, this Limited
Warranty automatically terminates.
Provisions Severable: If any
provision of this warranty shall be unenforceable,
this warranty shall be enforceable with respect
to every other enforceable provision.
NOTE: Consequential and incidental
damages are excluded and there are limitations
on implied warranties.
